RFID Tribe E-mail Service Policy and Agreement

RFID Tribe allows its paid members to use a "@rfidtribe.com" personalized email address.  RFID Tribe
members may send and receive messages using their own personalized RFID Tribe email address.

RFID Tribe members who use this Email Service agree with the following.

If you are found to be in violation of our policies at any time, as determined by RFID Tribe at its sole discretion,
we may warn you or suspend or terminate your account.

Please note that we may change our policies at any time.  It is your responsibility to keep up-to-date with and
adhere to the policies posted here.

You agree that you will use the Service in compliance with all applicable local, state, national, and international
laws, rules and regulations, including any laws regarding the transmission of technical data exported from your
country of residence. You shall not, shall not agree to, and shall not authorize or encourage any third party to:
(i) use the Service to upload, transmit or otherwise distribute any content that is unlawful, defamatory,
harassing, abusive, fraudulent, obscene, contains viruses, or is otherwise objectionable as reasonably
determined by RFID Tribe; (ii) upload, transmit or otherwise distribute content that infringes upon another
party's intellectual property rights or other proprietary, contractual or fiduciary rights or obligations; (iii) prevent
others from using the Service; (iv) use the Service for any fraudulent or inappropriate purpose; or (v) act in any
way that violates the email service policy, as may be revised from time to time. Violation of any of the foregoing
may result in immediate termination of this Agreement, and may subject you to state and federal penalties and
other legal consequences. RFID Tribe reserves the right, but shall have no obligation, to investigate your use
of the Service in order to determine whether a violation of the Agreement has occurred or to comply with any
applicable law, regulation, legal process or governmental request.

Prohibited Actions

In addition to (and/or as some examples of) the violations described above, users may not:
  • Generate or facilitate unsolicited commercial email ("spam"). Such activity includes, but is not limited to
- sending email in violation of the CAN-SPAM Act or any other applicable anti-spam law
- imitating or impersonating another person or his, her or its email address, or creating false accounts
for the purpose of sending spam
- data mining any web property (including RFID Tribe) to find email addresses
- sending unauthorized mail via open, third-party servers
- sending emails to users who have requested to be removed from a mailing list
- selling, exchanging or distributing to a third party the email addresses of any person without such
person's knowing and continued consent to such disclosure
- sending unsolicited emails to significant numbers of email addresses belonging to individuals and/or
entities with whom you have no preexisting relationship
  • Send, upload, distribute or disseminate or offer to do the same with respect to any unlawful, defamatory,
    harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content
  • Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items
    of a destructive or deceptive nature
  • Conduct or forward pyramid schemes and the like
  • Transmit content that may be harmful to minors
  • Impersonate another person (via the use of an email address or otherwise) or otherwise misrepresent
    yourself or the source of any email
  • Illegally transmit another's intellectual property or other proprietary information without such owner's or
    licensor's permission
  • Use Service to violate the legal rights (such as rights of privacy and publicity) of others
  • Promote or encourage illegal activity
  • Interfere with other users' enjoyment of the Service
  • Create multiple user accounts in connection with any violation of the Agreement or create user accounts
    by automated means or under false or fraudulent pretenses
  • Sell, trade, resell or otherwise exploit for any unauthorized commercial purpose or transfer any RFID
    Tribe email account
  • Use the RFID Tribe Email Service in connection with illegal peer-to-peer file sharing
  • Represent that the user is an employee of RFID Tribe or an agent of RFID Tribe.

Security
You must promptly notify RFID Tribe of any breach of security related to the Services, including but not limited
to unauthorized use of your password or account. To help ensure the security of your password or account,
please sign out from your account at the end of each session.

RFID Tribe email service is reserved for members who keep a current, paid membership.  Expiration of paid
membership will lead to immediate termination of the email service.

Abuse of this policy may lead to immediate loss or forfeiture of this email service and to immediate loss or
forfeiture of privileges as a member of RFID Tribe, at the sole discretion of RFID Tribe.
